{"id":345,"date":"2016-07-24T16:01:50","date_gmt":"2016-07-24T16:01:50","guid":{"rendered":"http:\/\/www.ldh.perpignan.lemedia.fr\/?p=345"},"modified":"2016-07-24T16:01:50","modified_gmt":"2016-07-24T16:01:50","slug":"procedure-dexception-loi-dexception","status":"publish","type":"post","link":"https:\/\/site.ldh-france.org\/ldh66\/procedure-dexception-loi-dexception\/","title":{"rendered":"Une proc\u00e9dure d&rsquo;exception pour une loi d&rsquo;exception"},"content":{"rendered":"<header class=\"article-header\">\n<h1><a title=\"Une proc\u00e9dure d\u2019exception pour une loi d\u2019exception\" href=\"http:\/\/www.ldh-france.org\/procedure-dexception-loi-dexception\/\" rel=\"bookmark\">Une proc\u00e9dure d\u2019exception pour une loi d\u2019exception<\/a><\/h1>\n<\/header>\n<section class=\"entry-content clearfix\"><strong>Communiqu\u00e9 LDH<\/strong>Les assauts de d\u00e9magogie qui ont pr\u00e9sid\u00e9 aux d\u00e9bats sur la prolongation de l\u2019\u00e9tat d\u2019urgence ne peuvent dissimuler que les mesures d\u00e9cid\u00e9es par le Parlement \u00e0 l\u2019initiative du gouvernement restreignent nos libert\u00e9s, sans pour autant \u00eatre un gage d\u2019efficacit\u00e9 dans la lutte contre les actes de terrorisme.La loi prorogeant pour une quatri\u00e8me fois l\u2019\u00e9tat d\u2019urgence, qui va \u00eatre adopt\u00e9e cet apr\u00e8s-midi, n\u2019est pas seulement inutile, elle est dangereuse.<\/p>\n<p>Elle est dangereuse parce qu\u2019elle p\u00e9rennise une situation d\u2019exception, parce qu\u2019elle laisse \u00e0 la discr\u00e9tion du gouvernement le droit de manifester et accro\u00eet les pouvoirs de la police au point de justifier de retenir un enfant pendant quatre heures et de saisir les donn\u00e9es personnelles sans r\u00e9el contr\u00f4le puisqu\u2019une nouvelle fois, le juge judiciaire est \u00e9cart\u00e9.<\/p>\n<p>Mais cette loi est aussi une atteinte directe au processus d\u00e9mocratique. En y int\u00e9grant des modifications p\u00e9rennes du Code p\u00e9nal, les parlementaires et le gouvernement ont institu\u00e9 une nouvelle mani\u00e8re de l\u00e9gif\u00e9rer, dans la pr\u00e9cipitation et au m\u00e9pris de toute r\u00e8gle d\u00e9mocratique. Bien entendu, comme on peut s\u2019y attendre, cette n\u00e9gation des principes du d\u00e9bat parlementaire ne sera pas soumise \u00e0 l\u2019appr\u00e9ciation du Conseil constitutionnel.<\/p>\n<p>La LDH condamne absolument une loi d\u2019exception adopt\u00e9e par une proc\u00e9dure d\u2019exception.<\/p>\n<p>Paris, le 21 juillet 2016<\/p>\n<p><a
