Communiqu\u00e9 de la LDH <\/strong><\/p>\n\n\n\n

L\u2019Organisation des Nations unies (ONU), saisie par la Ligue des droits de l\u2019Homme (LDH), a adress\u00e9, le 12 novembre 2020, \u00e0 monsieur le pr\u00e9sident de la R\u00e9publique des recommandations concernant la proposition de loi \u00ab S\u00e9curit\u00e9 globale \u00bb.<\/p>\n\n\n\n

Les termes utilis\u00e9s sont particuli\u00e8rement s\u00e9v\u00e8res \u00ab L\u2019information du public et la publication d\u2019images et d\u2019enregistrements relatifs \u00e0 des interventions de police sont non seulement essentiels pour le respect du droit \u00e0 l\u2019information, mais elles sont en outre l\u00e9gitimes dans le cadre du contr\u00f4le d\u00e9mocratique des institutions publiques<\/em> \u00bb.<\/p>\n\n\n\n

Elle consid\u00e8re ainsi de mani\u00e8re claire et sans ambigu\u00eft\u00e9 que l\u2019infraction de diffusion malveillante d\u2019images des forces de l\u2019ordre n\u2019est pas conforme aux principes de l\u00e9galit\u00e9, n\u00e9cessit\u00e9 et proportionnalit\u00e9. Par ailleurs, les rapporteurs sp\u00e9ciaux consid\u00e8rent que l\u2019instauration de la surveillance par drone et celle de la centralisation des images de cameras-pi\u00e9ton avec acc\u00e8s direct par les autorit\u00e9s polici\u00e8res, soul\u00e8vent d\u2019innombrables probl\u00e9matiques quant aux garanties du public et \u00e0 leurs libert\u00e9s fondamentales.<\/p>\n\n\n\n

La LDH demande instamment aux parlementaires de ne pas voter ces dispositions sauf \u00e0 porter une atteinte sans pr\u00e9c\u00e9dent \u00e0 l\u2019Etat de droit ainsi que les rapporteurs sp\u00e9ciaux de l\u2019ONU le rappellent.<\/p>\n\n\n\n

La France s\u2019inscrit dans une communaut\u00e9 internationale. Le respect des trait\u00e9s internationaux et des recommandations de l\u2019ONU est le seul moyen pour garantir sa cr\u00e9dibilit\u00e9 et sa stature aux yeux des autres nations.<\/p>\n\n\n\n
