{"id":2087,"date":"2017-06-08T13:11:33","date_gmt":"2017-06-08T12:11:33","guid":{"rendered":"http:\/\/site.ldh-france.org\/metz\/?p=2087"},"modified":"2017-11-05T10:32:37","modified_gmt":"2017-11-05T09:32:37","slug":"allocation-adulte-handicape-age-de-retraite","status":"publish","type":"post","link":"https:\/\/site.ldh-france.org\/metz\/2017\/06\/08\/allocation-adulte-handicape-age-de-retraite\/","title":{"rendered":"Allocation adulte handicap\u00e9 et \u00e2ge de la retraite."},"content":{"rendered":"<p><strong><a href=\"http:\/\/site.ldh-france.org\/metz\/files\/2017\/06\/AAH.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-2090 size-full\" title=\"AAH\" src=\"http:\/\/site.ldh-france.org\/metz\/files\/2017\/06\/AAH.jpg\" alt=\"Allocation Adulte Handicap\u00e9\" width=\"390\" height=\"308\" srcset=\"https:\/\/site.ldh-france.org\/metz\/files\/2017\/06\/AAH.jpg 390w, https:\/\/site.ldh-france.org\/metz\/files\/2017\/06\/AAH-300x237.jpg 300w\" sizes=\"auto, (max-width: 390px) 100vw, 390px\" \/><\/a>Allocation adulte handicap\u00e9, allocation de solidarit\u00e9 des personnes \u00e2g\u00e9es et passage \u00e0 la retraite.<\/strong><\/p>\n<p>Depuis 2006, d\u00e8s qu&rsquo;un b\u00e9n\u00e9ficiaire de l&rsquo;AAH dont le taux d\u2019incapacit\u00e9 est \u00e9gal ou sup\u00e9rieur \u00e0 80% arrivait \u00e0 l&rsquo;\u00e2ge l\u00e9gal de la retraite, il \u00e9tait tenu par les Caisses d\u2019allocation familiales d&rsquo;entreprendre des d\u00e9marches pour basculer dans le dispositif Aspa (Allocation de solidarit\u00e9 aux personnes \u00e2g\u00e9es).<\/p>\n<p>Mais l\u2019AAH et l\u2019ASPA, ce ne sont pas les m\u00eames droits, pas le m\u00eame fonctionnement. L\u2019Aspa est r\u00e9cup\u00e9rable sur succession ou la vente d\u2019un bien, ce qui n&rsquo;est pas le cas de l&rsquo;AAH.<\/p>\n<p>Martine DENIAU a refus\u00e9 ce transfert de prise en charge que la CAF voulait lui imposer et ce d\u00e9saccord a \u00e9t\u00e9 port\u00e9 devant le tribunal administratif de la s\u00e9curit\u00e9 sociale de Toulon. Le 26 janvier 2016, le tribunal a reconnu le bon droit de Martine Deniau de percevoir l\u2019AAH. Ce jugement fait jurisprudence.<\/p>\n<p>Ainsi, toute personne titulaire de l\u2019AAH, pour une incapacit\u00e9 d\u2019au moins 80%, peut conserver son AAH au moment de son \u00ab\u00a0d\u00e9part en retraite\u00a0\u00bb.<\/p>\n<p>La loi \u00e9nonce clairement cette r\u00e8gle depuis le 1er janvier 2017. Les allocataires de l&rsquo;AAH pourront continuer \u00e0 la percevoir au-del\u00e0 de l&rsquo;\u00e2ge l\u00e9gal de la retraite (62 ans en 2017). Le d\u00e9cret d&rsquo;application a \u00e9t\u00e9 publi\u00e9 au Journal officiel le 1er f\u00e9vrier.
